      June the 2, 1836. In the name of God, Amen. As life is uncertain and I being old and being blest with my senses proceed to make my last will.

      First, my farm, containing one hundred and eighteen acres of the west side of the North East quarter of Section No. 35, Rn. 01, town 3, Clark County, Ohio, I will to Elizabeth CARMAN my wife while she remains my widow. Also all my personal property.

      2 and at our deaths my son William CARMAN shall be the only heir to my wagon, plows & guns and rifull guns. Allso I give and bequith to him at our deaths (when the land is sold) fur hundreds dollars.

      third, I allso give and bequith the balance of my Reale estate and personal property to my darter Mary BUCKLES and Elijah CARMAN and Lutz CARMAN my son and John CARMAN my son and Samuel CARMAN my son and to my darter Elizabeth LONG [CORY?] and Nancy CARMAN my darter and my darter Eliza Ann CARMAN and Lobitha CARMAN my darter and Sally PRIEST my darter and her childon and I appoint Elijah CARMAN and Lutz CARMAN my sons as the executors of this my last will and testamony.

      PROBATE

      State of Ohio, Clark Count, Court of Common Pleas, June 30, 1840. Personally came in open court George RICHARDSON one of the subscribing witnesses to the last will and testament of Benjamin CARMAN, late of said county deceased who being duly sworn deposes and says that he was present at the execution of said will and that he saw the ___ testator sign and heard him acknowledge the same as his last will and testament and that at the execution thereof said testator was of full age, of sound mind and memory and not under any restraint.

      At a court of common Pleas held at the court house in Springfield on the 30th day of June 1840 the last will and testament of Benjamin CARMAN late of Pike Township Clark County Ohio dec'd was brought before the court and was proven in part by the oaths of George RICHESON one of the subscribing witnesses thereto whose examination was reduced to writing and placed on file and it appearing to the satisfaction of the court that William MERRIT the other subscribing witness does not reside within the jurisdiction of this court, but that he resides in Cass County, Indiana, on motion of the execution in said will named, it was ordered that a commission issue from this court directed to Peter MILLER Esq of Cass County Indiana, authorizing and directing the said Peter MILLER to cause the said William S. MERRITT to come before him at such place as he may direct without any unreasonable delay and to examine the said William MERRIT on oath v[?]ouching the execution of said will and the testimony of said witness to reduce to reduce to writing and after having reduced the same to writing and caused the same to be subscribed by said witness to enclose the same together with said will and transmit said testimony and will to the clerk of this court by the first day of the next term thereof.
